Native Plant Swap Terms Of Use

Your Safety Comes First!

Users access and utilize this website at their own risk. The administrator of this site, the Westside Watershed Resource Center (WRC), will not share your identity and contact information, but please be aware that you may share this information with other people as part of your participation in the site. Always use caution when agreeing to meet anyone. Do not post or give out any personally identifying information beyond what is necessary. As a poster, it may be easiest to meet people at your home where the plants are. However, you always have the option of meeting in a public place. If you notice any dangerous, abusive, inappropriate, questionable or unfriendly behavior or language as part of your participation in the Native Plant Swap, please report that user immediately to manager@westsidewatersheds.org. If any incidents occur, notify law enforcement and the WRC immediately.

Plant Disease

Please always check your plants for possible parasites or disease. Do not give away any plants you suspect may be infested with any type of pest or disease, and if you find something, please immediately seek professional help. Further, never transport plants out of established quarantine zones.

Plant Regulations

This website is a public service and resource, intended to crowd-source the sharing and swapping of plants native to the Portland, Oregon region in a manner conforming to all applicable local, state, and federal laws. As a part of using this website, you are subject to the regulations and guidelines of the Oregon Department of Agriculture, which regulates plant materials, their use and transport.

Conduct

While interacting with the Native Plant Swap program, participants and visitors to this site are to behave in ways that are honest, kind and generous to others and the Earth. They further agree not to use abusive, oppressive, or rude behavior and/or language on this website or when interacting with others using this website.

Liability

All are welcome to access this site, but the WRC expects people younger than 18 years old to seek adult help in posting and meeting up for plant swaps. Users assume full responsibility for any losses or damages incurred by using this site. Best efforts to ensure accuracy are no guarantee as to any of the information posted. By using this site, you agree not to bring any legal action against any of the creators or moderators of this site.

Nothing in these Terms of Use shall waive rights or responsibilities that cannot be waived by law.

The city of Portland and Neighbors West North-West shall not be liable for any lost profits or special, incidental or consequential damages (however arising, including negligence) arising out of or in connection with the use of this website. Indemnity. If someone brings a claim against the City of Portland or its elected officials, officers, or employees; or against Southwest Neighborhoods, Inc. or its officers, employees, or volunteers based on a harm you caused, you agree to reimburse the City of Portland or Neighbors West North-West, as applicable, for any costs incurred in defending against that claim, including reasonable attorneys’ fees as well as damages.
